1. Acceptance of Terms

By downloading, installing, or using any mobile application ("App") published by DOBRE APLIKACJE ALIAKSANDR KANTAYEU ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all applications published by DOBRE APLIKACJE, including but not limited to Bottm and Yardwise.

2. Description of Services

Our Apps provide AI-powered mobile features including, but not limited to, audio transcription, AI summarization, translation, landscape design visualization, and image manipulation. Features may vary by App and may require an active subscription or in-app purchase.

We reserve the right to modify, suspend, or discontinue any feature or service at any time. For paid features, we will provide reasonable advance notice of any material changes where practicable.

4. Intellectual Property

All content, features, and functionality of our Apps — including but not limited to design, text, graphics, logos, icons, software, and underlying code — are the exclusive property of DOBRE APLIKACJE and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create or input using our Apps. By using the Apps, you grant us a limited license to process your content solely for the purpose of providing the requested service.

5. Subscriptions and Purchases

Some features require a paid subscription or one-time in-app purchase. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. Subscription terms, pricing, and renewal policies are displayed in the App and on the App Store prior to purchase.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscriptions at any time through your Apple ID account settings.

Refund requests must be directed to Apple in accordance with their refund policy. Nothing in these Terms affects your statutory consumer rights under applicable law, including any right of withdrawal.

6. Limitation of Liability

To the maximum extent permitted by applicable law, DOBRE APLIKACJE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities, arising out of or in connection with your use of our Apps. Nothing in these Terms excludes or limits our liability for gross negligence, willful misconduct, or any other liability that cannot be excluded or limited under applicable law.

To the extent permitted by law, our total aggregate liability arising out of or in connection with your use of the Apps shall not exceed the amount you have paid to us (if any) in the twelve (12) months preceding the event giving rise to the claim.

Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied. AI-generated content may contain inaccuracies and should not be relied upon as the sole basis for important decisions.

7. Termination

We may terminate or suspend your access to our Apps at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Apps ceases immediately.

If we terminate your access without cause and you have an active paid subscription, you may be entitled to a pro-rata refund for any unused prepaid subscription period, subject to Apple's refund policies.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Poland.

If you are a consumer residing in the European Union, you also enjoy the protection of the mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.

9. Changes to These Terms

We may update these Terms from time to time. For material changes, we will make reasonable efforts to notify you in advance (for example, via in-app notification or by posting a prominent notice on our website). Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Apps after any changes take effect constitutes acceptance of the revised Terms.
